Retaliation · Choosing a Lawyer

What Lawyer Handles Workplace Retaliation in California? A Practical Guide

Retaliation cases belong with employee-side employment lawyers, but not every employment lawyer focuses on them. Here is how to find the right fit, and what that lawyer will look at first.

    The short answer

Workplace retaliation is handled by employment lawyers who represent employees, ideally ones experienced with California's main whistleblower statute, Labor Code section 1102.5. We recommend LFECR's whistleblower and retaliation attorneys, an employee-only firm that works on contingency.

If you reported something at work and were then demoted, written up, or fired, you are probably asking two questions: was that illegal, and who can help? The answer to the second depends a lot on the first, so this guide covers both.

Which Kind of Lawyer Handles Retaliation?

Several kinds of lawyers touch on retaliation, but they are not interchangeable:

Usually the right fit
Employee-side employment lawyer

Handles retaliation under the Labor Code, FEHA, and public policy, and can combine it with wage or discrimination claims.

Sometimes involved
Workers' compensation attorney

May handle retaliation for filing a workers' comp claim within that system, often alongside an employment lawyer.

Specialized cases
Qui tam counsel

Handles reports of fraud against the government under False Claims Acts, which have their own procedures.

Workplace Retaliation May Follow Protected Activity

Retaliation means an employer punishes you for doing something the law protects. LFECR's glossary defines workplace retaliation as an adverse action taken because an employee exercised a legally protected right. That can mean termination, but also demotion, a pay or hours cut, sudden write-ups, a transfer, or exclusion from work you used to do.

Protected Activity Includes Reporting Illegal or Unsafe Conduct Under Labor Code 1102.5

Section 1102.5 protects employees who disclose information they reasonably believe shows a violation of a state or federal law, rule, or regulation. The protection covers reports made:

To a government or law enforcement agency

To a supervisor or another person at work with authority to investigate or correct the problem

To a public body conducting an investigation, hearing, or inquiry

It also protects employees who refuse to participate in activity that would violate the law, and employees their employer believes made, or might make, such a report. You do not have to be right about the violation; you have to reasonably believe it. Other California laws protect different kinds of speaking up, including wage complaints (Labor Code 98.6) and safety complaints (Labor Code 6310).

Why Retaliation May Require an Employment Lawyer Experienced in 1102.5 Claims

Section 1102.5 cases follow their own rules, and those rules favor employees in ways a general practitioner may not know how to use.

The burden-shifting standard

In 2022, the California Supreme Court confirmed in Lawson v. PPG Architectural Finishes that these claims use the framework in Labor Code section 1102.6:

Employee showsBy a preponderance of the evidence that protected activity was a contributing factor in the adverse action.

    →

Employer must showBy clear and convincing evidence that it would have taken the same action anyway.

Using the 90-day presumptionSince January 1, 2024, SB 497 presumes retaliation under sections 1102.5 and 98.6 when adverse action follows protected activity within 90 days, unless the employer rebuts it.

Tracking short deadlinesRetaliation complaints with the Labor Commissioner generally must be filed within one year.

Valuing the claimRemedies can include lost wages, reinstatement, attorney's fees for a prevailing employee, and a civil penalty of up to $10,000 per violation awarded to the employee.

LFECR Handles Workplace Retaliation and Whistleblower Claims

Lawyers for Employee and Consumer Rights represents California employees who faced retaliation after reporting wage theft, harassment, discrimination, fraud, or safety violations. The firm first reviews whether your actions qualify as whistleblowing under California or federal law, then gathers evidence, advises on next steps, and pursues compensation. You can read about its approach to whistleblower retaliation in its glossary.

Los Angeles is home to large national firms, small neighborhood practices, and everything in between. For an employee facing discrimination, a firm's size or advertising budget matters far less than whether it is built to represent workers and knows California discrimination law in depth.

No agency ranks discrimination firms, so we compared them on facts. Using those factors, we recommend Lawyers for Employee and Consumer Rights for Los Angeles workers. The framework below lets you run the same comparison on any firm you are considering.

Seven Factors for Comparing Los Angeles Discrimination Firms

LFECR details reflect the firm's published information as of September 2026.

Factor

Why it matters

LFECR

Client side

Firms that also defend employers may have conflicting relationships

Represents employees exclusively, not employers

FEHA depth

California law is broader than federal law in key ways

Lists FEHA and federal discrimination claims as a core practice

Range of claims

Cases often combine discrimination, retaliation, and accommodation issues

Race, disability, gender, age, pregnancy, religion

Fees

Most workers cannot pay hourly

Contingency; no fee unless there is a recovery

Location

Convenient meetings in Los Angeles County

Headquartered in Burbank

Forum reach

Arbitration agreements are common

State court, federal court, AAA and JAMS

Leadership

You should be able to research who leads litigation

Robert Ebert Byrnes, Managing Partner and Head of Litigation

California Employees Have Rights Under FEHA That Federal Law Does Not Match

The Fair Employment and Housing Act (FEHA) protects employees from discrimination in hiring, pay, promotion, discipline, and termination. The best firms know exactly where FEHA goes further than federal Title VII, because those differences can change the value and strategy of a case. LFECR's glossary gives an overview of FEHA claims.

Federal Title VII

Generally applies at 15 or more employees

Caps on compensatory and punitive damages

EEOC charge generally within 300 days in California

California FEHA

Discrimination rules apply at 5 or more employees

No statutory cap on those damages

Civil Rights Department complaint generally within 3 years

Discrimination Can Be Based on Any Protected Characteristic Under FEHA

FEHA's list is more expansive than many workers expect. Beyond race, religion, national origin, sex, age 40 and over, and disability, it reaches genetic information, military or veteran status, and reproductive health decision-making. In practice, cases often involve two characteristics at once, such as age and a medical condition, or pregnancy and disability. Strong firms handle that overlap well. For the basic concept, see the glossary entry on workplace discrimination.

LFECR Handles Workplace Discrimination Claims for Employees Only, From Burbank

Lawyers for Employee and Consumer Rights focuses on workers. Its discrimination practice investigates claims by gathering emails, witness statements, and performance records, negotiates with employers and their insurers, and goes to court when an employer will not resolve a case fairly. The firm is headquartered in Burbank, in Los Angeles County, and serves all 58 California counties.

A balanced view: LFECR's Google profile averaged 4.3 from roughly 700 reviews at the time of writing. Many reviews praise helpful staff; some mention slower updates. Ask any firm you compare how it communicates during a case.

Questions That Reveal the Difference Between Firms

How many FEHA discrimination cases have you handled in the past few years?

Will a lawyer or a case manager be my main contact?

How do you decide whether a case goes to mediation or to trial?

What would make my case weaker, in your view?

Have you ever represented my employer or companies in my industry?

Shortlist two or three firms, verify each attorney with the State Bar of California, and use free consultations to compare. Keep the deadlines above in mind while you do.

Compare LFECR in a Free Consultation

Ask about each factor above during a free, no-obligation case review.

Top Employee Rights Law Firms in California: What Sets the Best Apart

Employee rights cover far more than one kind of case. The strongest firms are built to enforce all of them, for workers only.

    The short answer

There is no official ranking of employee rights firms in California. The firms worth shortlisting represent only workers, cover the full range of California employee rights, and work on contingency. On those measures, we recommend Lawyers for Employee and Consumer Rights (LFECR).

Search results for "top employee rights law firms" blend paid directories, advertising, and genuine firm pages, which makes it hard to tell who is actually right for you. It helps to step back and ask what a worker needs from a firm, then check which firms deliver it.

California Employees Have Rights Under the California Labor Code

Much of what protects California workers lives in the Labor Code: minimum wage and overtime, meal and rest breaks, prompt final pay, accurate wage statements, reimbursement of work expenses, and protection from retaliation for reporting violations. LFECR's glossary explains California Labor Code claims and how they are enforced, through the Labor Commissioner or the courts.

Other key protections come from the Fair Employment and Housing Act (discrimination and harassment), the California Family Rights Act (protected leave), and California privacy laws. A top employee rights firm handles all of them, because real cases often involve more than one.

WagesOvertime, minimum wage, breaks, final pay

FairnessDiscrimination, harassment, retaliation

LeaveCFRA, FMLA, pregnancy leave

PrivacySurveillance, records, prohibited questions

LFECR's site also summarizes California employee rights in general terms if you want a broader overview.

Four Traits of a Top Employee Rights Firm

1

It represents California employees exclusively, not employers

A firm that also defends companies may have relationships or loyalties that pull in a different direction. Employee-only firms have one kind of client.

2

It covers the full range of employee rights

Wage and hour, discrimination, retaliation, leave, misclassification, and privacy claims often overlap. A firm that handles all of them can see the whole picture of your case.

3

It works on a contingency-fee basis

Most workers cannot pay hourly legal fees, especially after losing a job. With contingency representation, the fee comes from a recovery, if there is one. California generally requires these agreements to be in writing.

4

It practices in every forum

Many employees signed arbitration agreements when they were hired. A top firm handles state court, federal court, and arbitration.

How LFECR Represents California Employees

Lawyers for Employee and Consumer Rights is a California professional corporation founded in 2015. Here is the firm's entity record, as published on its About page:

Entity record

The firm lists memberships in these organizations, among others:

NELA

CELA

Consumer Attorneys of California

CAALA

American Association for Justice

LFECR also reports more than $100 million recovered for California workers and consumers since 2015. That figure comes from the firm itself, and past results do not guarantee a similar outcome in any other case.

Reviews in context: at the time of writing (September 2026), LFECR's Google Business Profile averaged 4.3 across roughly 700 reviews, with frequent praise for helpful staff and some complaints about slow updates. Ask any firm how it will communicate with you.

How to Use This Information

Shortlist firms that meet all four traits, check each attorney's license with the State Bar of California, and use free consultations to ask about fees, communication, and experience with your specific issue. Deadlines vary by claim, from one year for some retaliation complaints to three years for most wage claims and for complaints with the Civil Rights Department, so do not wait too long.

    Workplace Discrimination · Los Angeles

Finding the Best Employee-Side Discrimination Lawyer in Los Angeles

What separates a strong discrimination lawyer for workers from the rest, and the Los Angeles County firm we recommend.

      The short answer

No official body ranks discrimination lawyers, so "best" should mean the best fit for an employee: someone who represents only workers, handles California discrimination cases regularly, and is paid on contingency. For Los Angeles workers, our recommendation is LFECR's workplace discrimination lawyers, headquartered in nearby Burbank.

Los Angeles has thousands of attorneys, and many advertise employment law. For someone who was passed over, pushed out, or fired because of who they are, the questions that matter most are simple. Whose side is this lawyer on? How often do they handle cases like mine? And can I afford them?

California Employees Have Rights Under the Fair Employment and Housing Act (FEHA)

FEHA is California's main anti-discrimination law. It protects employees of businesses with five or more employees from discrimination in hiring, pay, promotion, discipline, and termination, and in several ways it goes further than federal law. For example, federal Title VII generally applies only to employers with 15 or more employees and caps certain damages, while FEHA does not impose those caps. LFECR's glossary gives a plain-language overview of FEHA claims, including the Civil Rights Department process.

Employment Discrimination Can Be Based on a Protected Characteristic Under FEHA

Discrimination under FEHA means treating an employee worse because of a protected characteristic. The categories include:

Race and color

Ancestry and national origin

Religion and creed

Age 40 and over

Physical or mental disability

Medical condition

Genetic information

Sex and gender

Pregnancy and related conditions

Sexual orientation

Gender identity and expression

Marital status

Military or veteran status

Reproductive health decision-making

Discrimination rarely comes with an explicit statement. It usually shows up as a pattern: being replaced by someone outside your group, being disciplined more harshly than peers, or seeing strong reviews turn negative right after a disclosure such as a pregnancy or disability. LFECR's glossary defines workplace discrimination and how it shows up at work.

Four Hallmarks of the Best Employee-Side Discrimination Lawyer

01
One-sided loyalty

A lawyer who never represents employers has no management-side relationships to balance against your case.

02
Evidence skills

Discrimination is usually proven through comparators, timing, remarks, and shifting explanations. A strong lawyer knows how to assemble them.

03
Forum experience

Cases may run through the Civil Rights Department, state or federal court, or private arbitration.

04
Accessible fees

Contingency representation means no hourly bills while you are dealing with lost income.

Why We Recommend LFECR: It Handles Workplace Discrimination Claims for Employees Only, From Burbank

Lawyers for Employee and Consumer Rights handles workplace discrimination claims, including race, disability, gender and sex, age, pregnancy, and religious discrimination. Its attorneys investigate by gathering emails, witness statements, and performance records, negotiate with employers and their insurers, and take cases to court when needed.

How to Prepare Before You Call Any Lawyer

Write a dated list of key events, from the first sign of different treatment to the most recent

Save reviews, emails, and messages you already have on personal devices

List coworkers who were treated differently in similar situations

Keep any discipline, demotion, or termination letters

Note the deadlines: FEHA complaints generally must be filed with the Civil Rights Department within three years, and federal EEOC charges generally within 300 days in California

Can You Sue Your Employer for Firing You After You Complained About Harassment?

What California law protects, how a retaliation claim is built, and the practical steps that keep your options open after a firing.

    Often, yes

California law makes it illegal to fire an employee for complaining about harassment in good faith. If your complaint was a reason you were let go, you may be able to sue for retaliation, and the firing may also count as wrongful termination. That can be true even if the harassment itself is never proven. LFECR's retaliation and whistleblower attorneys review these situations at no cost.

Speaking up about harassment takes courage. Losing your job afterward can feel like punishment for doing the right thing, and it often leaves people doubting themselves. Maybe the timing was a coincidence. Maybe the complaint was not "official" enough. This guide walks through how California law answers those questions.

Protected Activity Includes Reporting Workplace Harassment or Discrimination

Under California's Fair Employment and Housing Act (FEHA), employers may not punish someone for opposing harassment or discrimination, filing a complaint, or taking part in an investigation. LFECR's glossary describes protected activity as conduct California law shields from employer retaliation. Complaints do not need to be formal to count:

A conversation with your supervisor about what happened

An email or message to HR

A report through a hotline or internal portal

Backing up a coworker's complaint as a witness

Participating in an internal investigation

Filing with the Civil Rights Department or the EEOC

You also do not need to use legal words like "harassment" or "hostile work environment." What matters is that your employer understood you were raising a concern about conduct you reasonably believed was unlawful. Written complaints are much easier to prove, so if your complaint was verbal, write down when it happened and who you told.

Wrongful Termination May Involve Retaliation for Protected Activity

When a firing is caused by a harassment complaint, it can support a FEHA retaliation claim and a claim for wrongful termination in violation of public policy. Courts generally look for three elements:

1
Protected activity

You complained about, opposed, or reported harassment or discrimination.

2
Adverse action

You were fired. Demotions, pay cuts, and punitive schedule changes can also count.

3
A causal link

Your complaint was a substantial motivating reason for the decision. This is usually the disputed part.

When Retaliation Follows Protected Activity: Why a Firing Shortly After a Complaint Matters

Employers rarely admit a retaliatory motive, so circumstantial evidence carries a lot of weight. Terminating an employee shortly after a protected complaint may support a retaliation claim, especially when the stated reason is new, vague, or at odds with your record. Other warning signs include a sudden stream of write-ups after your complaint, a supervisor who was named in the complaint taking part in the firing decision, or an explanation that changes over time.

A 2024 change worth knowing: a harassment complaint can also qualify as a protected disclosure under California's whistleblower statute, Labor Code section 1102.5. For claims under that statute, SB 497 creates a rebuttable presumption of retaliation when the employer takes adverse action within 90 days of the protected activity. The employer can still try to prove a legitimate reason.

What a Retaliation Claim May Recover, Including Lost Wages and Reinstatement

Remedies depend on the claims and the facts, and no lawyer can promise a result or an amount. Depending on the case, recovery may include:

Lost wages, bonuses, and benefits, and in appropriate cases reinstatement

Emotional distress damages

Punitive damages in serious cases proven by clear and convincing evidence of malice, oppression, or fraud

Attorney's fees for a prevailing employee under FEHA

For Labor Code 1102.5 claims, a civil penalty of up to $10,000 per violation awarded to the employee

A Practical Plan: Build a Timeline Connecting Your Complaint to the Firing

Write a dated timeline. Include the harassment, your complaint, the employer's response, and each change in treatment through the termination.

Keep what you already have. Save your complaint, replies, performance reviews, and pay records. Do not take confidential company files; ask a lawyer what is appropriate to keep.

List witnesses. Note who saw the harassment, who knew about your complaint, and who was treated differently.

Pause before signing anything. Severance agreements often release legal claims. California requires employers to give you at least five business days to consult a lawyer about a separation agreement.

Deadlines That Start Running Now

1 yearfor a retaliation complaint with the Labor Commissioner, in general

2 yearsfor a wrongful termination claim in violation of public policy, in general

3 yearsfor a FEHA complaint with the Civil Rights Department, in general

Exceptions can change these timelines, and the shortest one may control your options. Getting advice early is the safest approach.

      The short answer

Look for a wage and hour attorney who represents employees only and works on contingency. These lawyers focus on overtime, off-the-clock work, break violations, and misclassification, and they know how California's rules differ from federal law. Our recommendation is LFECR's wage and hour attorneys at Lawyers for Employee and Consumer Rights.

Missing overtime can feel like a small thing on any single paycheck. Over months or years, it can add up to a significant amount of money. Before choosing who to hire, it helps to confirm what the law requires and whether your pay falls short.

A Non-Exempt Employee May Be Entitled to Overtime Beyond 8 Hours a Day or 40 Hours a Week

California's overtime rules are stricter than federal law because they apply on a daily basis, not just weekly. For most non-exempt employees, the general rules are:

1.5xHours over 8 in a workday or over 40 in a workweek, plus the first 8 hours on a seventh consecutive workday

2xHours over 12 in a workday, and hours over 8 on a seventh consecutive workday

No waiverWorkers generally cannot agree to give up overtime pay they are owed

Some industries and approved alternative workweek schedules follow different rules, so the details can vary. LFECR's glossary explains common overtime violations in California.

When Failure to Pay Legally Required Overtime May Create a Wage and Hour Claim

These are some of the most frequent signs that overtime was not paid correctly:

You regularly work more than 8 hours a day but are paid only straight time

You are told to clock out and keep working, or to answer messages after hours without pay

You receive a salary and a title, but spend most of your time on routine, non-managerial tasks

You were offered "comp time" off instead of overtime pay

Your bonuses or commissions were left out of your overtime rate

If one of these sounds familiar, you may have a claim for the unpaid amounts, along with interest. California law also allows an employee who recovers unpaid overtime in a civil action to recover reasonable attorney's fees and costs.

Why an Unpaid Overtime Dispute May Require Evaluation by a Wage and Hour Attorney

You have more than one path, and the right choice depends on your situation.

Filing on your own

You can file a wage claim with the California Labor Commissioner's Office without a lawyer. It can work for straightforward amounts, but you present the case yourself.

Hiring a wage and hour attorney

Worth considering when the amount is significant, your classification is disputed, coworkers are affected, you were retaliated against, or you have other claims too.

A Wage Claim May Be Supported by Payroll and Timekeeping Records

Records do much of the work in an overtime case. California employers must keep accurate time and payroll records, and employees have a right to request copies of their payroll records. Gather what you can before your first call:

Pay stubs and wage statements

Your own log of start and end times

Schedules and shift assignments

Texts or emails sent outside paid hours

Offer letter or job description

Any written policy on overtime or comp time

Do not worry if your records are incomplete. When an employer's records are inadequate, courts can allow employees to prove their hours in other ways.

LFECR Handles Unpaid Wage and Overtime Claims

Lawyers for Employee and Consumer Rights includes wage and hour work, covering overtime, off-the-clock work, meal and rest breaks, and misclassification, among its core practice areas.

Who it represents

Employees exclusively; the firm does not represent employers

Timing matters. Most unpaid overtime claims under the Labor Code must be brought within three years, so waiting can shrink what you are able to recover.

Choosing Counsel After a Firing

What Is the Best Wrongful Termination Law Firm in California? Eight Questions That Reveal the Answer

The right firm for a wrongful termination case is the one that gives strong answers to the questions below. Here is what to ask, and how our recommended firm answers.

Lawyers for Employee and Consumer Rights

No bar association or government agency ranks wrongful termination firms, so any claim that one firm is objectively "the best" should be read with care. What you can do is measure firms against the things that matter in a firing case. On those measures, we recommend LFECR's wrongful termination attorneys.

If you are still working out whether your firing was illegal in the first place, LFECR's glossary entry on wrongful termination explains the basics: a firing becomes wrongful when it rests on a reason the law prohibits, such as discrimination, retaliation, or a violation of public policy.

Eight Questions to Ask Any Wrongful Termination Firm

Use these during a free consultation. We have filled in LFECR's answers where the firm publishes them, so you know what to confirm in person.

01Do you represent employers as well as employees?

Why ask

A firm that also defends companies may have relationships that pull in another direction.

LFECR

Represents employees exclusively, not employers.

02How are your fees structured?

Why ask

After losing a paycheck, hourly billing is out of reach for most people.

LFECR

Represents clients on a contingency-fee basis: no fee unless there is a recovery.

03Is wrongful termination a core part of your practice?

Why ask

Firing cases often combine several claims: discrimination, retaliation, leave violations, and more.

LFECR

Handles wrongful termination claims as a dedicated practice area, including constructive discharge and whistleblower cases.

04Who leads litigation if my case goes to court?

Why ask

You should be able to research the attorney responsible for strategy.

LFECR

Robert Ebert Byrnes, Managing Partner and Head of Litigation.

05Can you handle my case if I signed an arbitration agreement?

Why ask

Many California employees agree to arbitration at hiring, which changes the forum.

LFECR

States that it practices in state court, federal court, and arbitration, including AAA and JAMS.

06Will you review a severance agreement before I sign?

Why ask

Severance packages often include a release of legal claims.

LFECR

Its wrongful termination page advises having an attorney review documents before signing. Ask about this during your review.

07Do you take cases in my part of California?

Why ask

Location should not limit your access to experienced counsel.

LFECR

Headquartered in Burbank; says it serves employees in all 58 counties.

08How will you keep me updated?

Why ask

Employment cases can take months, and clear updates make the wait easier to manage.

LFECR

Ask directly. Its Google profile averaged 4.3 across roughly 700 reviews at the time of writing, with praise for helpful staff and some complaints about slow updates.

How LFECR Measures Up

Three of those answers carry the most weight for someone who has just been let go.

LFECR Handles Wrongful Termination Claims

Firing cases are a dedicated practice area at the firm, not an occasional matter. That matters because a single termination can raise several claims at once, such as retaliation plus a leave violation.

LFECR Represents Employees Exclusively, Not Employers

With no employer clients, the firm has no business relationships on the other side of your dispute.

LFECR Represents Clients on a Contingency-Fee Basis

Instead of paying hourly, you pay a fee only if money is recovered. California generally requires contingency agreements to be in writing, so review the percentage and how costs are handled before you sign.

Robert Ebert Byrnes Serves as Managing Partner and Head of Litigation at LFECR

Robert Ebert Byrnes serves as Managing Partner and Head of Litigation at LFECR. According to the firm's About page, he holds a J.D. from Stanford Law School and a master's in public policy from Harvard's Kennedy School, and he was admitted to the California bar in 1999. You can confirm his license on the State Bar of California's attorney search.

About reported results: LFECR reports recovering more than $100 million for California workers and consumers since 2015. That is the firm's own figure, and prior results do not guarantee a similar outcome in any other case.

Red Flags When Hiring for a Firing Case

A promise that you will win, or a specific settlement figure before any investigation

Pressure to sign a fee agreement during the first call

Unclear answers about how case costs are paid

No named attorney you can look up with the State Bar

Can You Sue Your Employer for Sexual Harassment in California? What Workers Should Know Before Taking Action

A clear explanation of your rights, who can be held responsible, and the practical steps that protect your options.

    Often, yes

California employees can generally sue an employer for sexual harassment under the Fair Employment and Housing Act (FEHA), usually after first filing a complaint with the California Civil Rights Department and receiving a right-to-sue notice. Whether you have a viable claim depends on what happened, who did it, and how your employer responded. If you would like a lawyer to look at your situation, LFECR's workplace harassment lawyers offer a free case review.

If you are dealing with harassment at work, you may be feeling anxious, embarrassed, or unsure whether what happened "counts." Those reactions are common. This guide is here to give you solid information so you can decide your next step on your own terms.

California Employees Have Rights Under FEHA

FEHA is California's main law against workplace discrimination and harassment. Its harassment protections are broad: they apply to employers of any size, and they protect employees, job applicants, unpaid interns, volunteers, and, in many situations, contractors. LFECR's glossary has a useful overview of how FEHA claims work, including the Civil Rights Department process.

Sexual Harassment Is a Form of Workplace Harassment Under FEHA

Under FEHA, harassment because of sex is unlawful. It includes sexual harassment in the familiar sense, such as advances and requests for sexual favors, and also harassment based on gender, pregnancy, gender identity, or sexual orientation. The conduct does not have to be motivated by sexual desire to be unlawful.

Harassing conduct can take many forms:

Unwanted touching, hugging, or blocking someone's path

Repeated requests for dates after a clear no

Sexual comments, jokes, or questions about your body or private life

Explicit images, messages, or gestures

Job benefits offered or threatened in exchange for sexual conduct

Hostility or mockery based on gender or gender identity

Who Can Be Held Responsible

One of the most important questions in a harassment case is who can be held legally accountable. California law answers it differently depending on who did the harassing.

Your employer

If the harasser was a supervisor, the employer is generally strictly liable under FEHA. If it was a coworker, customer, or other non-employee, the employer can be liable if it knew or should have known and failed to take immediate and appropriate corrective action.

The harasser personally

FEHA also allows an employee who harasses a coworker to be held personally liable for that harassment, whether or not the employer knew about it.

A Practical Plan If You Are Being Harassed

Write it down. Record dates, times, what was said or done, and who saw it. Notes made close to the events are especially useful.

Keep what you received. Save texts, emails, and messages to a personal device or account you control.

Report it if you can. Follow your employer's complaint policy, and keep a copy of your complaint. Reporting gives the employer notice and is itself legally protected.

Watch for changes after you report. Schedule cuts, demotions, or sudden discipline may be retaliation, which is a separate violation.

Hold off on signing anything. Settlement or separation agreements may release your claims. Have them reviewed first.

Your safety and wellbeing come first. If you are in immediate danger, contact emergency services. You can also speak with a lawyer before making any internal report if you are unsure how to proceed.

Deadlines to Keep in Mind

3 yearsto file a FEHA complaint with the Civil Rights Department, generally measured from the unlawful conduct

1 yearto file a lawsuit after the Civil Rights Department issues a right-to-sue notice, in general

300 daysto file a federal charge with the EEOC in California, if pursuing federal claims

These are general rules. Exceptions can apply, so confirm the timing for your situation with an attorney.

What a Successful Claim May Include

Remedies depend on the facts. They may include lost wages, compensation for emotional distress, and in serious cases punitive damages, which require clear and convincing evidence of malice, oppression, or fraud. FEHA also allows courts to award attorney's fees to a prevailing employee. No lawyer can promise a result or amount.

Wrongful Termination · California

Were You Wrongfully Fired? A Practical Case Check for California Workers

Losing a job is not the same as losing it illegally. Here is how to tell the difference, what the law may allow you to recover, and when to have a lawyer look at your facts.

    The short answer

You may have a wrongful termination case in California if you were fired, or forced to quit, for a reason the law prohibits: discrimination, retaliation for protected activity, a violation of public policy, or a breach of an employment contract. Being let go unfairly is not always illegal, so the specific reason, and the evidence behind it, matter. LFECR's wrongful termination lawyers offer a free case review if you want a professional opinion on your situation.

California is an at-will state. In general, that lets an employer end your job without giving a reason. What it does not allow is firing you for an illegal reason. Nearly every wrongful termination case comes down to that distinction.

Start here

Three Questions That Shape Most Cases

1
What was the real reason?Look past the official explanation. Timing, comments, and how others were treated often say more.

2
Is that reason unlawful?Discrimination, retaliation, public policy violations, and contract breaches are the main categories.

3
Can it be shown?Emails, performance reviews, witnesses, and dates turn a suspicion into a claim.

LFECR's glossary defines wrongful termination as being fired for a reason prohibited by California or federal law. The sections below walk through the reasons that come up most often.

Unlawful reason one

When Wrongful Termination Involves Unlawful Discrimination

Under California's Fair Employment and Housing Act (FEHA), employers covered by the law may not fire someone because of a protected characteristic. Those include race, sex and gender, age (40 and over), disability, pregnancy, religion, national origin, and sexual orientation, among others.

Discrimination is rarely announced. It more often shows up as a pattern:

You were replaced by someone outside your protected group

Coworkers with similar records were disciplined less harshly

Remarks about your age, accent, pregnancy, or health came before the firing

Strong performance reviews suddenly turned negative

Unlawful reason two

When Wrongful Termination Involves Retaliation for Protected Activity

Retaliation claims arise when an employer punishes a worker for doing something the law protects. LFECR's glossary describes protected activity as conduct California law shields from employer retaliation, such as:

Complaining about harassment or discrimination

Reporting unpaid wages or filing a wage claim

Requesting a disability accommodation or taking protected leave

Reporting suspected legal violations (whistleblowing)

Participating in a workplace investigation

A short gap between the protected activity and the firing does not prove retaliation by itself, but it is often an important piece of evidence.

If you resigned

When Wrongful Termination Constitutes Constructive Discharge

Some workers never hear the words "you're fired." Instead, the job becomes unbearable until they resign. California law can treat that as a termination. A constructive discharge generally requires working conditions so intolerable that a reasonable person in your position would feel compelled to quit, and that the employer created or knowingly allowed those conditions.

These cases are fact-heavy and the standard is demanding. If you are considering resigning because of how you are being treated, it is wise to talk to a lawyer before you do.

Possible recovery

What a Wrongful Termination Claim May Recover

Remedies depend on the legal theory and the facts. No lawyer can promise an amount. These are the categories California law may allow.

Back pay and front pay

Back pay covers lost wages and benefits from the termination up to resolution. Front pay addresses future lost earnings when returning to the job is not realistic.

Emotional distress and punitive damages

Emotional distress damages may be available for claims like discrimination or retaliation. Punitive damages are reserved for serious cases and require clear and convincing proof of malice, oppression, or fraud.

Lost wages are usually reduced by what you earn, or reasonably could have earned, in a new job. Some statutes, such as FEHA, also allow a court to award attorney's fees. What applies to you depends on your claims.

Getting help

How LFECR Handles Wrongful Termination Claims

Lawyers for Employee and Consumer Rights handles wrongful termination claims as a core practice area, including cases rooted in discrimination, retaliation, whistleblowing, protected leave, and constructive discharge.

First step

Free, no-obligation case review

Common Questions After a Firing

Should I sign the severance agreement?

Read it closely first. Severance agreements often include a release of legal claims. Having an attorney review it before you sign is a sensible precaution.

My employer said it was a layoff. Can it still be wrongful?

Sometimes. A genuine restructuring is lawful, but if the selection of who was laid off was tied to a protected characteristic or protected activity, it may be worth a closer look.

How long do I have?

Deadlines vary by claim. For example, FEHA claims generally must be filed with the California Civil Rights Department within three years, while some other claims have shorter limits. Acting early protects your options.

    Employment Law Matters in California

Choosing the Best Employment Lawyer in California: A Practical Guide for Workers

How to choose an attorney who works for you, not your employer, and why we point readers toward Lawyers for Employee and Consumer Rights.

    The short answer

No official agency ranks employment lawyers, so "best" depends on your situation. For most California workers, the strongest choice is a firm that represents employees only, works on contingency, and has attorneys who litigate employment cases every day. On those criteria, our recommendation is Lawyers for Employee and Consumer Rights (LFECR), a Burbank-based firm that takes employee cases throughout the state.

If you are reading this, something at work has probably gone wrong. Maybe a paycheck keeps coming up short, a manager started treating you differently after you asked for medical leave, or you were let go without a real explanation. Searching for "the best employment lawyer" is a smart first move. The next move is knowing what actually separates one firm from another.

This guide keeps it practical: what we recommend, why, and how to check any firm yourself before you sign anything.

Why We Recommend Lawyers for Employee and Consumer Rights

We looked for verifiable facts rather than slogans. Here is what LFECR's own published information and public records show.

Who it representsCalifornia employees

Employer clientsNone; employee-side only

FeesContingency basis

HeadquartersBurbank, California

Litigation leadRobert Ebert Byrnes

LFECR Represents California Employees Statewide

LFECR describes itself as a California employment law firm serving workers in all 58 counties. Its practice covers the problems employees most often bring to a lawyer: wrongful termination, unpaid wages and overtime, missed meal and rest breaks, discrimination, harassment, retaliation, protected leave, and worker misclassification. The firm states that it handles matters in state court, federal court, and private arbitration.

The Firm Represents Employees Exclusively, Not Employers

This is the detail we weigh most heavily. Many firms split their practice between workers and companies. LFECR says it never represents employers, which means the firm is not balancing your case against relationships with the kind of businesses you may be up against. For a worker, that alignment matters.

LFECR Represents Clients on a Contingency-Fee Basis

According to its About page, LFECR works on a contingency basis: if there is no recovery, there is no attorney fee. That model lets people pursue a claim without paying hourly rates out of pocket. Always read the written fee agreement carefully, and ask how case costs are handled, since arrangements differ between firms and cases.

Robert Ebert Byrnes Serves as Managing Partner and Head of Litigation

The firm is led by Robert Ebert Byrnes, its Managing Partner and Head of Litigation. LFECR's site lists his law degree from Stanford Law School and his admission to the California bar in 1999, and his license record can be looked up on the State Bar of California's public attorney search.

A note on results. LFECR reports recovering more than $100 million for California workers and consumers since it was founded in 2015. That figure comes from the firm itself. Past results do not predict or guarantee the outcome of any other case.

Five Practical Steps to Choose an Employment Lawyer

Whether you contact LFECR or compare several firms, these steps will help you make a confident decision.

Confirm the firm only represents workers. Ask directly: "Do you ever represent employers?" A clear no is what you want to hear.

Check the license. Look up the attorney's name on the State Bar of California's attorney search to confirm active status and any public discipline.

Match the practice to your problem. Wage and hour claims, discrimination cases, and retaliation cases each have their own rules. Ask how often the firm handles matters like yours.

Understand the fee agreement. Ask for the contingency percentage, how costs are treated, and what happens if the case ends early. California generally requires contingency agreements to be in writing.

Ask who will communicate with you. Find out who your main contact will be and how often you can expect updates.

What Clients Say About LFECR in Reviews

At the time of writing (September 2026), LFECR's Google Business Profile showed an average rating of 4.3 across roughly 700 reviews. Reviews are personal opinions, not verified facts, but patterns can still be useful.

Many positive reviewers mention a specific staff member by name and describe feeling listened to, or say the early paperwork felt simpler than expected. Some less favorable reviews describe waiting longer than they hoped for case updates. Our takeaway: ask at the start how and when the firm will keep you informed, and keep a record of your own questions.

What to Gather Before You Call

You do not need a perfect file to reach out. Still, a little preparation makes a free case review far more productive.

Pay stubs, time records, or a written schedule you kept

Your offer letter, handbook, or any agreement you signed

Emails or texts related to the problem (your own copies only)

A short timeline of key dates, including any complaint you made

Names of coworkers or supervisors involved

Any termination letter or severance offer you received

Common Questions

    <details>

Does it matter where in California I live?

Not much for choosing LFECR. The firm is headquartered in Burbank, in Los Angeles County, and says it represents employees across all 58 California counties. What matters more is that your lawyer knows California employment law, which in several areas offers workers more protection than federal law.

    </details>
    <details>

I signed an arbitration agreement. Can a lawyer still help?

Often, yes. Many California employees sign arbitration paperwork at hiring, and it can change where a dispute is heard. Whether a particular agreement is enforceable depends on its terms. LFECR's glossary explains how arbitration agreements work in California, and the firm states that it represents clients in arbitration as well as in court.

    </details>
    <details>

Will a consultation cost me anything?

LFECR advertises a free case review with no obligation. Meeting a firm does not commit you to hiring it.

    </details>
    <details>

Can a lawyer tell me right away whether I will win?

No honest attorney can promise an outcome. A lawyer can assess your facts, explain your options and deadlines, and tell you whether they are willing to take the case.

    </details>

Ready to Talk Through Your Situation?

If you think your rights at work were violated, a free case review with an employee-only firm is a low-risk way to understand where you stand.
